Terms of Service
These Terms of Service ("Terms") govern your access to and use of KevField (the "Service"). By creating an account or using the Service, you agree to these Terms.
1. The Service
KevField provides a construction-project management workspace, including document storage, AI-assisted summaries, RFIs, submittals, change orders, planning, and team collaboration. Features may change over time.
2. Accounts
You must provide accurate information and are responsible for all activity under your account. Keep your credentials confidential. Notify us immediately of any unauthorized use.
3. Subscriptions & Billing
Access to project workspaces requires an active paid subscription. Subscriptions renew automatically unless canceled before the end of the current period. Fees are non-refundable except where required by law. Prices and available plans may change with notice.
4. Your Content
You retain ownership of files, documents, and project data you upload ("Your Content"). You grant KevField a limited license to host, process, and display Your Content solely to operate the Service — including generating AI summaries and enabling team access based on the roles you configure.
5. Copyright & Intellectual Property
All content, design, code, trademarks, and materials on the KevField website and in the Service are the property of KevField or its licensors and are protected by copyright, trademark, and other intellectual-property laws. You may not copy, modify, distribute, reverse-engineer, decompile, or create derivative works from any part of the Service or its underlying code without express written permission. If you believe material on our site infringes your copyright, contact us at contact@kevfield.com with a detailed description of the alleged infringement and the location of the material.
6. Acceptable Use
You agree not to: (a) upload unlawful, infringing, or malicious content; (b) attempt to access data you are not authorized to view; (c) reverse-engineer or disrupt the Service; (d) use the Service to send spam or violate others' privacy; or (e) use the Service in violation of applicable law.
7. AI Features
The Service uses AI to summarize contracts, extract information from documents, draft tasks, and answer questions ("Kevin AI"). AI output may be inaccurate or incomplete. You are responsible for verifying important details before relying on them for contractual, financial, or safety decisions.
8. Third-Party Services
The Service integrates with third parties (e.g., payment processors, email providers, AI model providers). Your use of those services is subject to their terms. We are not responsible for third-party services.
9. Confidentiality
You agree to treat project information accessed through the Service as confidential and to use it only for legitimate project purposes consistent with your role.
10. Termination
You may stop using the Service at any time. We may suspend or terminate access for violation of these Terms, non-payment, or if required by law. Sections that by their nature should survive termination will survive.
11. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted or error-free.
12. Limitation of Liability
To the maximum extent permitted by law, KevField will not be liable for indirect, incidental, consequential, special, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of the Service. Our total liability will not exceed the amounts paid by you to KevField in the twelve months before the claim.
13. Indemnification
You agree to indemnify and hold KevField harmless from claims arising out of Your Content or your breach of these Terms.
14. Governing Law
These Terms are governed by the laws applicable at KevField's principal place of business, without regard to conflict-of-laws principles. Disputes will be resolved in the courts of that jurisdiction, unless required otherwise by mandatory local law.
15. Changes
We may update these Terms from time to time. Material changes will be communicated by email or in-app notice. Continued use after changes take effect constitutes acceptance of the updated Terms.
